§ 1 Scope

These Terms and Conditions apply to all contracts between Alexander Stelzner, Manufaktur X (hereinafter "Provider") and the customer (hereinafter "Buyer") concluded via the online shop at manufakturx.de and associated domains.

Deviating terms of the Buyer are not recognised unless the Provider expressly agrees to them in writing.

§ 2 Contract Formation

The presentation of products in the online shop does not constitute a legally binding offer but is a non-binding invitation for the Buyer to place an order.

By submitting an order, the Buyer makes a binding offer. The Provider confirms receipt of the order by email (order confirmation). The contract is concluded when the Provider accepts the order by sending an order acceptance or by delivering the goods.

As all products are custom-made to individual specifications, the Provider reserves the right to decline an order within 3 business days of receipt if the requested configuration is not technically feasible.

§ 3 Prices and Payment

All prices are quoted in euros and include the applicable statutory value-added tax. Shipping costs are shown separately and are borne by the Buyer unless otherwise stated.

Payment is made by credit card, instant bank transfer, or other payment methods offered at checkout. Payment is processed via the payment service provider Stripe.

For custom-made products, the Provider may require a deposit of up to 50% of the total price upon ordering. The remaining balance is due before dispatch.

§ 4 Delivery

Delivery is carried out by freight carrier to the delivery address specified by the Buyer (curbside). The average delivery time is 3 to 6 weeks after order confirmation, depending on the product and configuration.

Deliveries are made throughout the EU and UK.

The Provider is not liable for delivery delays caused by force majeure or circumstances beyond its control. In such cases, the Buyer will be notified without delay.

§ 5 Right of Withdrawal

Consumers have the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which the Buyer or a third party designated by the Buyer takes possession of the goods.

To exercise the right of withdrawal, the Buyer must inform the Provider (Alexander Stelzner, Manufaktur X, Sarmanna Strasse 22, 93049 Regensburg, email: info@manufakturx.de) by means of a clear statement of the decision to withdraw from the contract.

Exception: The right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer (Section 312g(2)(1) BGB). As all products by Manufaktur X are individually custom-made to order, the right of withdrawal is excluded for custom-made products.

§ 6 Warranty

Statutory warranty rights apply. The warranty period is 2 years from receipt of the goods. Defects must be reported to the Provider in writing or by email without delay after discovery.

Natural material characteristics such as wood grain, slight colour differences, or minimal dimensional variations in handcrafted products do not constitute a defect.

§ 7 Liability

The Provider is liable without limitation for damages arising from injury to life, body, or health, as well as for intent and gross negligence.

In cases of slight negligence, the Provider is only liable for breach of essential contractual obligations (cardinal obligations). In such cases, liability is limited to the foreseeable, contract-typical damage.

The above limitations of liability do not apply to claims under the Product Liability Act or in the event of an assumed guarantee.

§ 8 Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

If the Buyer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is the Provider's registered office in Regensburg.

Should individual provisions of these Terms and Conditions be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
